This website is operated by Experimental Loop Inc., a domestic non-stock corporation incorporated in the State of Connecticut, United States, operating as a nonprofit organization under Section 501(c)(3) of the Internal Revenue Code (status in process). Employer Identification Number (EIN): 99-0516542. The organization operates under the commercial name “Experimental Loop” and may be referred to in specific contexts as “Experimental Loop International Video Art Festival.”
2. Scope and Acceptance
By accessing, browsing, applying to, or interacting with this website, including submitting applications to open calls, making donations, or communicating with the organization, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree, you must refrain from using the website.
3. Nature of the Organization
Experimental Loop is an independent international cultural project dedicated to video art. It is not a commercial platform, not a marketplace, and not a high-margin business. Participation in its activities does not create any employment, agency, partnership, fiduciary, or contractual relationship beyond what is explicitly stated herein.
4. Open Calls and Applications
Experimental Loop may organize open calls that may be free or require an application fee, depending on the specific edition or program. All conditions applicable to each open call, including eligibility, deadlines, selection criteria, fees, and the existence or absence of prizes, are disclosed prior to application. Submission of an application does not guarantee selection, exhibition, inclusion, prize, payment, or any form of compensation.
5. Prizes and Awards
Not all editions include prizes. When prizes are offered, they are subject to availability of sponsor funding or grant disbursements. Experimental Loop does not guarantee immediate payment. Prize disbursement may take up to twelve (12) months from the official date of award. This period is final and non-negotiable. Payment processing fees charged by third-party services (including but not limited to PayPal, Venmo, Western Union, or similar platforms) are deducted from the awarded amount. Experimental Loop does not cover such fees. Payments are made exclusively in United States Dollars (USD). Currency conversion rates, exchange fees, or losses resulting from conversion are the sole responsibility of the recipient. Cash or check payments may be offered at the organization’s discretion and may involve additional risks assumed by the recipient.
6. User Submissions and Responsibility
Users may submit audiovisual works, images, texts, and personal information solely through official application forms. All submitted content remains the sole responsibility of the submitting individual. Experimental Loop does not verify ownership, originality, or legality of submitted materials and assumes no liability for disputes arising from such content.
7. Intellectual Property and Collection Inclusion
By submitting an application and accepting the conditions of participation, applicants certify that they are the sole intellectual author and rights holder of the submitted work. If selected, the work automatically becomes part of the Experimental Loop Collection, exclusively for non-commercial, archival, educational, and promotional purposes. This includes display on the organization’s website, social media, digital publications, live presentations, and official YouTube channels, without time limitation and without additional compensation.
8. Limitation of Liability
Experimental Loop shall not be liable for any indirect, incidental, consequential, reputational, financial, or emotional damages arising from participation, non-selection, delayed payments, technical failures, third-party services, or public exposure of selected works.
9. Third-Party Platforms
This website may include links to third-party platforms, including Amazon (Print-on-Demand catalogs), payment processors, or hosting services. Experimental Loop is not responsible for third-party terms, policies, transactions, fulfillment, refunds, or disputes.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Connecticut, United States. Any dispute shall be subject to the exclusive jurisdiction of the state or federal courts located in Connecticut.
